The Law Pertaining to the Lease of Residences for Touristic Purposes in Turkey, along with Amendments to Several Laws, was officially published in Gazette number 32357 on November 2, 2023.
The primary objective of this legislation is to outline the procedures and principles governing the leasing of residences for touristic purposes, applicable to both individuals and legal entities.
The Law encompasses provisions addressing the general principles of leasing residences for touristic purposes in Turkey, the issuance of permits, administrative penalties, and the legal framework applicable to residences leased for touristic purposes.
It is important to note that leases exceeding one hundred days at a stretch are explicitly exempt from the scope of this Law.
Under the newly introduced regulations:
- Property owners involved in touristic leasing activities in Turkey are mandated to submit permit applications to the Ministry of Culture and Tourism within one month, commencing from January 1, 2024.
- Unanimous consent of condominium owners within the building where a residence is situated is a prerequisite for leasing the property for touristic purposes. Furthermore, a plaque obtained from the Ministry must be prominently displayed at the residence’s entrance used for touristic leasing.
- The permit issuance process is slated to conclude within three months from the date of application.
- Individuals whose applications are not accepted are prohibited from operating, but the rights of tenants in these residences will persist until the conclusion of the contractual period.
- Residences leased for a period of 100 days or less will be categorized as touristic residences under the Law. Conversely, leases exceeding 100 days will not fall within the ambit of this legislation.
- Notifications for residences leased for touristic purposes will be governed by the Identity Notification Law, with compliance responsibility resting on the permit holder.
The provisions of the Law pertaining to rentals for touristic purposes in Turkey are set to take effect on January 1, 2024.
